I think ASIC is there for exactly this kind of complaint. He can complain about false and misleading statements by the company. There is probably enough evidence to at least warrant ASIC investigations.

I think discouraging investors from using the protections which are made available to them is not really that helpful.

ASIC are there to investigate exactly matters like this.

The sad reality is that if Aussies suspicions prove to be correct, there will be no money and our stock will be worthless. However, at least it would provide certainty

On the other side if he is wrong and there was a real buyer, the ASIC will investigate, find nothing and release nothing publicly.
