31.03.2015 Order - Directions Hearing
The Court makes orders in the following terms:
1. The trial in this action listed to commence on 7 April 2015 be vacated and relisted for eight
days commencing 20 May 2015.
2. The defendant be granted an extension of time to 27 February 2015 to file and serve its amended
defence.
3. the plaintiff be granted an extension of time to 4 March 2015 to file and serve its amended reply.
4. The defendant be granted an extension of time to 11 March 2015 to file and serve its further
list of documents.
5. The plaintiff be granted an extension of time to 18 March 2015 to file and serve the statements
of Mr Stephen Frederick Johnston and Mr Robert Paul Tolliday.
6. The plaintiff be granted an extension of time to 24 March 2015 to file and serve the statement
of Mr Anthony Dean Lethlean.
7. The plaintiff to file and serve a sealed copy of the statement of Mr Ian Jeffrey Gandel as soon
as practicable following that statement arriving from Melbourne, Victoria, into the possession
of the plaintiff’s solicitors.
8. The plaintiff has permission to file and serve a fourth statement of claim in the form provided
to the Court on 27 March 2015 by close of business on 31 March 2015.
9. The defendant is to file any amended defence by 10 April 2015.
10. The plaintiff, if so advised, to file and serve the statement of Mr John Dunlop by 8 April 2015.
11. The plaintiff to file any amended reply by 17 April 2015.
12. The plaintiff to file and serve any expert accounting report by 15 April 2015.
13. The defendant to serve any expert accounting report by 1 May 2015.
14. The plaintiff to serve any responding report to any expert accounting report by 14 May 2014.
15. The defendant to serve any expert reports in response to those of Mr Rich by 1 May 2015.
16. The plaintiff to file any expert reports in response to the respondnig reports to Mr Rich by 14
May 2015.
17. The defendant to file and serve statements containing the evidence in chief of its proposed
witnesses by 24 April 2015.
18. The plaintiff to provide to the defendant in electronic form a draft index to a joint tender book
listing all documents, other than expert reports, that the plaintiff intends to tender at trial by
24 April 2015.
19. The defendant to provide to the plaintiff an amended draft index to the joint tender book listing
all documents other than expert reports that the plaintiff intends to tender at trial by 1 May
2015.
20. The plaintiff to lodge with the Court two copies, and provide to the defendant one copy, of the
joint tender book by no later than 8 May 2015.
21. The plaintiff and defendant each file and serve by 13 May 2015:

(a) a schedule showing which, if any, documents in the joint tender book will be the
subject of objection;
(b) a schedule of objections, where any objections are taken, to each other’s written
statements; and
(c) a schedule of objections in relation to the expert report(s) filed by the parties.
22. Counsel for the parties are to confer by no later than 18May 2015 with respect to such objections.
23. Adjourned for further directions to 4 May 2015 at 9:30 a.m.
24. Liberty to the parties to apply at short but reasonable notice.
