Well it's a stick business. I want to speculate on the legal case but I'm not a lawyer. So it is important that no one rely on what I or anyone else says.

Half the time you can't even rely on what lawyers say and that's a fact. Because in each case there is one winner and one loser, that both relied on lawyers. 50% of the time they are right and 50% of the time they are wrong by virtue of the system. Not completely true a good lawyer should never send you to court if you have a losing case. Sometimes the lines are blurry, sometimes there not. Sometimes people are pig headed and push to go ahead on principle. Principle doesn't get you anywhere unless you have a sound case to push.
