I don't know anything about the case or what transpired so speaking generally, if a party has the opportunity to settle or take a reasonable settlement offer and didn't take it, could have costs awarded against them on that basis.
Notwithstanding the above, a good drill result would allow people forget this issue in an instant. (A bit of bad timing given the spud yesterday and court announcement today).
3.8 cent must seem like a bargain relative to prices early this week and last week! Didn't we touch 5 cents recently?
