De novo, I like your interpretation. With your obvious legal background you can see that all that it seems may not be how it is. Isn't that how the legal profession works?

Prof Lingrend maybe was chosen as the mediator due to his deep understanding of ethics in commercial law. The M&D conduct case is based on the ethical behaviour between the JV partners is it not?

The M&D case was adjourned soon after going into mediation. It has been quite a while now, why hasn't any progress been made? It is obviously on hold until the outcome of the settlement.
