A re-tender would be a definite possibility if and only if the licence given to AVQ was deemed as illegal. I think that by granting AVQ an extension to their lease, the judge has already prempted that it is not likely going to re-tender.
Another way of looking at is that by granting an extension to the licence in question, AVQ would seem to have favouritism over the other tenders and therefore a fair re-tender is unlikely.
From the little information we do have it would certainly appear as though AVQ are favoured to win.
What I don't believe has been discussed is that if SMM lose, they may consider suing the SI Government for damages. This may be offset against the damages owed by SMM to AVQ.
