It would have been thrown out if it was a criminal case.
In fact, a criminal trial was aborted and plans for a retrial were abandoned. There were genuine reasons for both but the holes in this case are such that only a spendthrift with a good sense of humour (with acknowledgment to Mr Bert Bryant, may he RIP) would contemplate a criminal trial.
