Civil: is a dispute between two or more citizens.
Criminal: Is the state making an allegation of criminality.
In a civil case the court is making a judgment about who more likely correct in a dispute between two parties. It's hard to find a better method of resolution than who is probably in the right, in a matter in which the state carries no interest.
