. Precisely how a judge can determine that part of a decision by a jurist that failed the most basic test: that of having being formed on an impartial basis can be allowed to stand is beyond farcical. Either Sofronoff came to his decisions on an impartial basis in which case they should stand, or they came (or could reasonably be seen as having come) as a consequence of an improper association with Albrechtsen and should be struck out. The finding of this latest inquiry is perhaps the definitive fiasco of this saga: that some of the findings of an inquiry conducted by a biased jurist should be allowed to stand. It does rather make a mockery of throwing out an entire jury on the grounds that one of their number was in possession of academic research on the propensity or otherwise of complainants to make false accusations of rape. One rather suspects that a corrupt judge is a greater impediment to legal process than a juror reading academic research.
