I completely disagree with the statement that the market is sophisticated enough to sort itself out.
Like it or not, the "free market" is basically the law of the jungle - no controls, no order, no values, no objectives. This leads to wild swings, where the powerful take advantage of the weak.
Regulation is required to moderate the swings, and to prevent the theft that normally occurs. In my view, the market is severely UNDER regulated.
ALL shorting should be banned - this is wealth destroying, just permitting the strong to manipulate the market.
I also believe when you buy a stock, the stock should be escrowed automatically for 3 months, so you can't sell for 3 months. T+3 settlement, but minimum holding time is 3 months. This would get rid of daytraders, shorters, speculation, pump + dump scenarios, lots of things.
After all, if the market is intended as a long term investment, why is it even legal to daytrade?
