I thought the point BGA was making is the same one they would have made if the ACCC or anyone else had opposed their own bid on anti-competitive grounds. What BGA didn't say was that they would be happy to accept 9.50 from MG if they had the opportunity.

But if your implied reading is right, that throws another uncertain element into the mix!
