    The Hon. Courtney Houssos,

Still no public statement as to what’s causing the delay preventing you from making your decision in relation to PEP 11.

As of today, there has been no reports of any recent comments from you or your office about PEP 11. However, from what I can ascertain so far from multiple phone calls over the last week to the DRNSW MEG Assessments is that the PEP 11 permit extension is a “complex” application for the DRNSW MEG Assessments to deal with. Exactly why it is considered so "complex" is a mystery to me, when the assessment has already been undertaken by NOPA. It is also my understanding that this application is uncommon (i.e. there is and only has ever been one offshore application in NSW which is PEP11). This caused me to question whether the level of experience within the DRNSW MEG Assessments may be too limited for such a task and that this could be the cause of the ongoing delay.

In addition, there is the matter of the recent NSW Environmental Planning and Assessment Amendment (Sea Bed Mining and Exploration) Bill 2024. If you supported this Bill (which I’m assuming you did, but which no-one from your department is willing to confirm), then any decision you make on PEP11 may not be impartial by virtue of apprehended bias.

Shareholders have clearly had enough of the disgraceful treatment we have received, with our concerns going unaddressed, being left in limbo for so long without any reasonable explanation as to why. We have been placed in an untenable position where we are forced to ramp up our efforts to try to communicate with your office, DRNSW MEG Assessments office, NOPTA, the press and anyone else who will listen to our grievances.

Could you please provide a timely and detailed response as to why it’s taking so long for you to make a decision or alternatively, could you please make your decision and publicly announce your position on the PEP11 permit extension, either in favour or not, as further delays are unacceptable and unjustifiable for all of the reasons clearly communicated within my emails.

    Yours sincerely,
