I would suggest when the US government, having spent almost 14 months on due diligence, including technical reports and now legal documentation, turns around and says NO!
Personally speaking, I would think that it wouldn't have got this far if there wasn't a chance of funding being granted.
In saying that, to keep the forum thread happy, it could be knocked back on the whim of a public servant.
No one knows.
