Litigation Timelines

Sorry for a new thread but all other threads are garbage thanks to the bunch of dimwit losers posting incoherent garbage even after MMGA lost

For my own curiosity i wanted to understand the litigation timelines:

ICSID

Scope:

The primary relief AVZ seeks is a declaration that it holds title to PR13359 over the entirety of the Manono Project and an order compelling the grant of the PE over the entirety of the Manono Project.

Provision Scope:

In the absence of steps being taken to address these developments, AVZI, GLH and Dathcom have been forced to seek provisional measures including an urgent order to preserve the status quo and an order to confirm or restore ownership of PR13359 to Dathcom.

Timelines for Provisional Scope

In relation to the application for provisional orders, the ICSID tribunal has directed:

• the State file a defence by 20 November 2023;

• AVZI, GLH and Dathcom file a reply by 27 November 2023;

• the State file a rejoinder by 4 December 2023; and

• thematter be listed for a virtual hearing for 2 hours on 11 December 2023.

Conclusion:On Dec 11^th, PR13559 is confirmed as AVZ owned and all other activities stop. Great, just in time for Felix to face the music

Dathomir vs AVZ

Provisional Scope

AVZ and AVZI previously applied to the arbitral tribunal acting in ICC arbitration proceedings (ICC No. 27401/SP) for provisional measures to preserve the status quo including an injunction compelling Dathomir to:

• withdraw the application to the Commercial Court of Lubumbashi to dissolve Dathcom; and

• comply with the arbitration clause in the 2020 SPA and, in particular, to refrainfrom bringing any action before a DRC local court on grounds that prejudge the issues at stake in the ICC arbitration proceedings.

Timelines for Provisional Scope

The ICC tribunal indicated it will rule on AVZ and AVZI’s application for provisional measures on 19 December 2023

Conclusion:On Dec 19^th, All DRC court action is nullifiedincluding Comminier’s supposed dissolution of Dathcom. This therefore negates all activities since then.

In respect of the broader arbitration proceedings against Dathomir:

. • Dathomir’s defence is due to be filed on 4 March 2024.

Conclusion:Dathomir is not a big issue for us, we do not need this to relist but its good to see it will be done before May-24

Zinjin vs AVZ

The key milestones summarised below:

• post-hearing briefs to be filed on 24 November 2023;

• statement of costs to be filed on 8 December 2023; and

• subject to the proceedings, draft award to be provided to ICC in late January 2024.

Conclusion: This is done, it’s a matter of payment of fee’s now . The failure of MMGA opens a clear door for MOU which must be occurring now. Anyone care to comment on whetherthere is anything open on Zinjin vs AVZ?
