IMF typically wears the cost of the litigation, and in return gets a fairly hefty slice of anything made.
The litigation, and what is accepted assuming they win, is ultimately in their hands but the reality is most people could not afford to fund a case (so something is better than nothing) and most insto's that could afford it would not want the additional cost and uncertainty risk.
The short of it is, that anyone eligible has very little to lose by taking part. Simply another long-term uncertainty for the company assuming they are successful in surviving as a going concern.
