Just stating “Really good news” could be “we have a new logo” or “we reached an employee headcount goal” - you can’t string someone up for an open statement like that.
price sensitive news - as defined by rulings - that’s different.
so if he said something like “we have really good news regarding funding/approvals/results” - and that is outside proper channels, yeah, you can get smacked.
there would have to be substantial proof, with more than simple circumstantial timing alone which tied an open statement like that to a previous announcement that was open to update or a new bit of news where you could directly link to the rhetoric.
Just stating “Really good news” could be “we have a new logo” or...
