There was an issue with the Native Title determination on Lake Disappointment that I could not accept.

It was the decision that the Martu people had the right to receive terms from RWD that the Martu would accept otherwise the lease would not be granted.

In the Native Title Act there is no right of veto by the native title holders over the lease.

Yet the right of refusal to terms no matter how reasonable must be the same as a right of veto.

As it is likely that only one lake will be developed at least for a number of years a negotiated outcome is now a rational possibility.
