    A company is in breach of the Corporations Act if it trades insolvent. Directors duties in this regard are defined in section s588g of the Act and there are penalties for non-compliance.

    ASIC Regulatory Guide 217 details a Director's duties with regards to insolvent trading and the consequences of non-compliance.
