settlement must be imminent now, my guess is the best was to frame a cash payment to kcn is to do it to look like a loan which is going to lead to economic development and jobs , in settlement rather than a hand down of a fine the Thais get to save a lot of face, in making a say 500m usd loan which starts the mine pays zurich a bit and leaves plenty of cash left over , they can have a royalty system that looks like loan repayments but is really a royalty or tax stream which the company would face anyway
