In fact it's clear by the way the s44 order was drafted that they were attempting to be cute and "draft" their way out of legal consequences under TAFTA by referencing the closure of all gold mines in Thailand (only one at the time). They knew about the defence under TAFTA and international law that they can take action only if it's for the health and safety of people/animals/environment and non-discriminatory. Unfortunately law doesn't work that way. What you say or how you say it doesn't protect you, it's whether it's factual or not.
