Yes it's always a wise choice to have your i's dotted and your t's crossed when displaying an Avatar that has Copyright Law standing behind it !

One never knows who might inform the authorities on what you think is a harmless display of Kramer from Seinfeld as an Avatar, little would you expect that could be classified as theft of Intellectual Property.
