The $5000 was paid to the agent to act against the interests
of the vendors. Both the buyer and the agent were aware of the agent's obligation to act in the vendor's interests.
They conspired to defraud the vendor to their financial benefit. Sounds criminal the way it was told in the first place and proudly repeated ad nauseum.
