As I understood it from a third party you can still appeal for leave to appeal and seek approval thereof despite not having lodged in time.
His comment however was that this is a clear cut matter so it would be frowned upon and unlikely - opinion was the ATO would have had more than sufficient time to lodge and what would have been the impediment to lodging that they would put forward.
No expert but think it seems logical. Don't think the Company would have put the notice out unless reasonable certainty.
Market just could not care IMO.
