DB, I can only go on the information I've seen with my own eyes, and unfortunately I'm not at liberty to share all of it. However, I will reiterate - published research is another form of prior art. The particular IP may not be covered by patents elsewhere, but if it is covered by research that has been published elsewhere it still constitutes prior art. It's no different to graphene itself - the discovery of, and research into, graphene which was originally performed by the two Russian scientists credited with its discovery was never patented. Their research was simply published for the benefit of the scientific community. But just because they didn't patent their original discovery and methods doesn't mean that someone else can come along and patent it as their own invention. It exists now purely as prior art.
I meant to add - the list of patents that I provided previously was simply to establish the credentials of Dr Yolshina.
