I guess NWS had to pull a stunt given that NWS' Weekend Australian and other titles were ineffective in pressing the Telstra SP has gone up too far too fast mantra. What impeccable timing, bring a Court Case for the failing, loss-accumulating JV called FoxTel with a case that FoxTel can't possibly win, even if they win, it will be a pyrrhic victory, see below:

NWS in the FoxTel consortium is seemingly winning in trying to destroy AFL and AFL Live in favor of their "Telstra" NRL Premiership (supporting by a handful of low-cost suburbs in Sydney, Brisbane, Townsville and the North of England and no one else) while everyone that supports the AFL gets treated to a shrunken screen as a way of destroying the interest in AFL that was across Australia in every state and every suburb that is not low cost enough not to follow Rugby League. Crowds in AFL are well down and interest is shrinking all due to the corporate objectives of News and Telstra's ill-fated sponsorship IMHO.
