I do not believe they could do that under Oz co law or under ASX listing rules, but what do I know. Times are interesting however, and I believe that Mr Loh and the other bidder will probably sort things out to their own mutual benefit assuming a third bidder does not enter the fray.
As I have said in previous posts Mr Loh does control a majority of the shares thus can block anything, and if he wants can continue the company as it currently is.
