I paid, you paid, we all paid including ERM. IMO Warf should have paid or relinquished it's % pro rata.
We all had issues with the CR after CR because first it was this much then increased to that much... but again we all paid.
If Warf want their 10% still then they should pay what is owing & then take legal action if they feel they need to & not the path they have chosen. I agree with Fitnfam as these are JV's & you either go with the flow or you get out.
