Likely what will happen at the 3 year point is that the ASX will send a generic letter, FAS will send a non-specific reply and the suspension will carry on. Shareholders expect ASX/ASIC to actually enforce its own listing rules and regulations but going by what has carried out here, that is clearly not the case.
