Minister Dismisses Appeal Against the AELB's Decision to Approve The temporary Operating License For LAMP.

Lynas Corporation is pleased to announce that the appeal, which was lodged under the Atomic Energy Licensing Act in relation to the decision of the Malaysian Atomic Energy Licensing Board (AELB) to approve the issuance of a temporary operating license (TOL) for the Lynas LAMP has been dismissed by the Minister.
In dismissing the appeal the Minister affirmed the 1 February 2012 decision of the AELB to approve the issuance of the TOL.
A copy of the Minister's press release setting out the details of his decision and the conditions of the TOL is attached.

Lynas has responded and says that it has readily available solutions to satisfy the new conditions announced by the Minister.

The next step will be the tabling and debate of the PSC's report to Parliament on Tuesday the 19th of June 2012.

Lynas has passed every review by the Malaysian Department of Environment,the IAEA,AELB and now the MOSTI. Lynas looks forward to the ISSUANCE OF THE TOL.

1. The plan and location of the Permanent disposal facility must be submitted by Lynas within 10 months of the issuance of the TOL.

2. The AELB has the right to appoint an independent assessor to evaluate Lyns's compliance with the stipulated standards and regulations and the cost will be borne by Lynas.

3. The reside/waste generated by the Lynas LAMP during the tenure of the TOL shall be the responsibility of Lynas, including if necessary, the return of said residue to the source of origin.

The TOL SHALL ONLY BE ISSUED BY THE AELB ONCE LYNAS has COMPLIED WITH ALL THE STIPULATED CONDITIONS,INCLUDING THE TWO ADDITIONAL CONDITIONS.

So now the ball is firmly in Lynas's court to convince the AELB that it is in compliance with ALL license conditions before the TOL will be actually issued.
We now wait with crossed fingers, baited breath etc
