M+K Great Southern class action struck out Wednesday October 20, 2010
Bendigo and Adelaide Bank (BEN) advises that Justice Croft of the Victorian Supreme Court has struck out the amended statement of claim in the class action brought against BEN by the law firm Macpherson + Kelley ("M+K") on behalf of investors in Great Southern managed investment schemes. In the decision, Justice Croft found that having regard to the nature and extent of the pleadings deficiencies, I am of the view that it is appropriate that I order that the Amended Statement of Claim be struck out in its entirety, with liberty to the Plaintiffs to file and serve another statement of claim.
