His honor struck out one paragraph. Concluding that the whole case is dead and burried is silly and wrong. His honor does allow a new statement of claim to be filed which keeps all options open. A small win but far from a big win Mr Hirst!
What the judge said was basically that common directorships... does not establish a common knowledge, common control or common liability as was claimed by M&K. It is an interesting view in light of the fact that many directors were directors in both GTP and Great Southern Finance and surely would have known everything about either company. He is basically saying directors know bugger all of the comanies they are directors in...
