If there is significant gold in the current samples and the Company is aware of it, it is misleading the market as a reasonable person may have sold, at a loss. If the Company later comes out and produces significant gold results from the same samples then it is liable for a legal case against it.
If the current "assay" technique does not produce reliable assays then it should not be reported.
