CLONCURRY miner CuDeco Ltd could be set back by more than $1 million in fines if it is found guilty of two alleged breaches of the Aboriginal Cultural Heritage Act (2003) dating back to 2012.
A spokesperson from the Department of Environment and Heritage Protection said the company was due to appear in Cloncurry Magistrates Court for mention on December 6 to face two charges relating to the alleged disturbance of artefacts and areas of Aboriginal significance during the clearing of land and construction of ground water bores near Fishers Creek in 2012.

CuDeco will face one charge of failing to meet the cultural heritage duty of care, and one charge of unlawful harm to Aboriginal cultural heritage under the ACH Act.
CuDeco could be liable to pay a maximum $750,000 for each breach of the Act if it is found guilty.
