Our law firm, Parsons Behle & Latimer, represents Marion Energy Inc. in the lawsuit you reference, as brought by Iowa Tanklines in the Federal Court for the State of Utah. Iowa Tanklines recently requested permission from the Court to file an amended complaint to assert some additional claims, including a claim that certain salary payments made to Marion employees should not have been paid. It is our collective belief that the claims alleged by Iowa Tanklines are completely lacking in merit. The wage payments in question, which were relatively small, were paid out for past due wages, in some instances wages that had not been paid in months. Indeed, any and all payments that were made were paid out to Marion’s creditors and employees for past due debts. In the event that Iowa Tanklines is given permission to file an amended complaint, it is Marion Energy, Inc.’s intention to file an answer that categorically denies Iowa Tanklines misplaced assertions and to vigorously defend against such baseless allegations. I am confident that the Court will ultimately determine that Iowa Tanklines’ entire case is without merit and is nothing more than an attempt by Iowa Tanklines to jump to the front of the line of creditors.
