    Mind you I doubt shareholders will get much, if anything after all the debts are settled.

    SECOND AMENDED SCHEDULING
    ORDER

    Plaintiff Iowa Tanklines, Inc. and Defendants Marion Energy, Inc. and OEL Operating
    (USA), Inc. (collectively, the “Parties”) hereby jointly move the Court for entry of a Second
    Amended Scheduling Order modifying the current Scheduling Order to extend all existing
    Case 2:12-cv-00006-DS Document 56 Filed 08/14/12 Page 1 of 3

    deadlines in this matter. The Parties have been actively engaged in settlement negotiations over
    the past sixty (60) days and have focused their efforts on reaching a potential resolution. To
    allow the parties to continue those discussions, and to finish discovery, which will necessitate
    several out-of-state depositions, if a settlement is not reached, the Parties request that the existing
    deadline to add parties and amend pleadings be pushed back by approximately 75 days and all
    other remaining deadlines be pushed back by approximately 45 days. As a result of the
    foregoing, the Parties request that trial in this matter be scheduled during a time convenient to
    the Court in April 2013, or as soon as dispositive motions (if any) have been resolved.
    A proposed Second Amended Scheduling Order, agreed to by the Parties and consistent
    with this Joint Motion, is attached hereto as Exhibit “A” and will be sent separately to chambers
    via Email.
