Before the Court is a Motion for Summary Judgment filed by Plaintiff Electrical
Contractors, Inc. (“ECI”). (Doc. 59.) ECI’s summary judgment motion was filed on September
23, 2011 (Doc. 59), along with the Affidavit of Joseph C. Rust (Doc. 60). Defendant Marion
Energy, Inc. (“Marion Energy”) has not filed any opposition to the summary judgment motion.
Having reviewed ECI’s Motion for Summary Judgment and Mr. Rust’s affidavit, and
having received no response to that motion and affidavit from Marion Energy,
IT IS HEREBY ORDERED that ECI’s Motion for Summary Judgment (Doc. 59) is
GRANTED.
IT IS FURTHER ORDERED that:

1. ECI is granted judgment against Marion Energy in the amount of $274,382.83, together
with interest thereon at the rate of 18% per annum from January 30, 2009, until the date of this
judgment.
2. ECI is awarded its attorney fees in the amount of $25,340.00.
3. ECI is awarded court costs in the amount of $1,768.09.
4. The total amount of the judgment is the sum of $456,780.58, which shall continue to
accrue interest at the rate of 18% per annum.
5. The hearing scheduled for November 28, 2011, at 9:30 A.M. is stricken.
