Can't in fact unless that was a Cross-claim filed and I'm sure that there wasn't.
An Order for indemnity costs is the maximum 'penalty'. If KDR were to win, then it would seek such an Order. If successful, then that should mean that KDR should have most, if not all, of its legal costs paid by Marindi.
