Kritiana, i doubt the ATO care less about the contract. the fact is that CFE themselves said it was due and payable, and kept claiming it as an asset,not to mention the fact that Tony Sage was always "confident" they would get it....been a while since he said that though. So if CFE said it was due and payable, why should the ATO question it if it was to their favour?
