IMO they had a two out of three loss on Appeal. Please read the judgement. At the end of the day the rental to Chris Benson's daughter is pretty irrelevant. I think the findings were still that it was a "in house asset" because of the 5% Rule. IMO in terms of opening this up as a precedent, I don't think its really going to have a bearing.
