Total guess with no basis, but if the mud thrown re PH has any substance, then why wouldn't he start another company, do a deal to transfer the IP, rely on proxy where it is needed, and then run THAT company to the NASDAQ and leave all of us in the dust. Doesn't have to be ethical, just legal.
