Is activist short selling legal in Australia?

Activist short selling is not prohibited in Australia, provided the short sellers do not breach corporations law. For example, while short selling is allowed, it is illegal for short sellers to disseminate fraudulent information.

Whilst many of our multi posters herein appear clever enough to disguise their posts with poor English, to the reasonable person in a court of law their message would be extrapolated for what it is, an attempt to force the price of a stock down. Given these posts are often penned with false or misleading information, the poster(s) may well be held liable..

It's okay though, the world is watching. Some of us have kept a dossier of these post(s) and poster(s) details for future reference. The relevant authorities can be put on notice at the appropriate time. As you are aware many of these posts are potentially illegal. If for example a poster(s) could not justify a statement such as "McMansion's in San Fransisco were acquired as a result of IMU's recent run", whilst at the same time they were shorting a stock, well...I'll let you be the judge..
