Firstly the article is written by the Dairy Industry :

So no surprises on their misleading article.
Second, A2M has been advertising various claims over many years. They are well versed in the labelling laws in every jurisdiction. They know how litigious the US is, so they would have taken no risks and would have evidence to back their claims.
And finally, the US Dairy industry is so pathetic and the US laws so lax in this space, that plants/nuts mixed with 90% water have called themselves "milk" and stolen 13% market share from dairy. If they can't stop those groups selling "milk" they'll never touch A2M.
All they will do by these actions is provide significant free advertising to people to who are dairy intolerant and haven't yet heard about A2 milk. A2M have been playing this game for the last 15 years.
