    I think the key word there is ‘sane’, who knows - as the article says he is prone to epiphanies - maybe he’ll have one soon ! Fruit loop !

    Provided sworn affidavits and then under cross examination changed his tune ? Lucky the case wasn’t dismissed entirely.

    On 20 September 2017 the Plaintiffs provided a list of the evidence on which they proposed to rely at the hearing, which included significant parts of six affidavits sworn by Mr Shearwood and four affidavits sworn by Mr Klinger (List of Evidence). Objections to evidence were prepared by Allied on the basis of the List of Evidence.



    Allied further contended that Mr Shearwood’s evidence in cross-examination was that he knew all about, and was involved in, the implementation of the deeds of arrangement and the sweat equity scheme that underpinned the oppression suit. It contended that the Court would not accept his evidence that he had some sort of epiphany about them which led to the claims made in the proceeding.
