Exactly! Particularly, given that everyone, or most, seems to agree that the term sheet is not binding if the conditions are not met.
Therefore, going back to the original post (by Stewie) that the agreement with SKI is a 'done deal' was wrong - because the conditions precedent have not been met. Simple!
