    Vintage, I am not a backslapper but I feel you are confused about the sense of the binding contract.
    it is not binding in the sense of they are committed to buy from auz(at this point). They are however committed to the company until that date is missed, then they are free to walk.
    ask yourself, can sk walk at this moment? If the answer, which it is, is no then at this moment they are BOUND to the actions of Australian mines.
    sk are BOUND to the fact they are a potential customer and bound by not being able to cancel the contract until 19th of Sep. Then if it is not met they are no longer bound to auz. Where as if they are met sk will then be bound to be a customer as long as auz continually meet the specs which would be specified in a more detailed contract.
