you said if ski can walk away then it is not binding.
in my post I feel I touched on this and the question I ask you is, can sk walk away at this present point? The answer is no. So they are bound until the 19th of September. Then if the milestone is not met they are no longer bound to the contract. At the moment sk are bound to the conditions of the term sheet.
in answer to your question no it is not a done deal, it is a long way from it. If you believe people with WAX in their heads it was never a deal to begin with.
