Regarding the potential copying of a MEMS device like the Bluechiip tag, it must be noted that Bluechiip has been working with STMicroelectronics since 2010 (see http://www.st.com/web/en/press/en/t3121?s_searchtype=keyword) to get the product to where it is today. Given that STMicroelectronics is the #1/2 MEMS contract foundry in the world, and it has taken them and the company 4 years to get to the point of a commercial tag/chip, with previous work being done internally and with another foundry between 2005 and 2010, this is not so easy to copy/replicate.  The company has a suite of over 20 patents, some relating to the memory device, which provide it as much protection as possible.  The key is to commercialise, get the product accepted, etc, etc.
