I'm undecided, but pointing out that there is ample warning in the fine print that the promise may not be able to be delivered is totally irrelevant. I have never seen a prospectus that doesn't contain that type of warning. If you believe that is something that should be considered in this proposal, then I am afraid that, to me, anything else you say is probably irrelevant too ...
