There is a charity accepting a transfer of units for free. Jim Byrnes was offering to buy units. Google Aussie Stock Forums and Brisconnections to find these. Then there is Judge Robson's judgement, in which he clearly indicates that it is legal for unit holders to escape the call by transferring their units to another party, which is contrary to statements made by BCS to unit holders. In fact, I believe that the directors of BCS have a legal obligation to correct these statements made to unit holders, and may be in breach of the continuous disclosure provisions of the corporations act if they fail to do so. I would urge anyone still holding units and wishing to divest themselves of them to contact the company and ask for their stance on transferring units prior to the SIRD, and ask for a written record. I am surprised that there has been no response to Judge Robson's judgement that transfers of units, off-market or otherwise, did not represent a criminal action.

You can find the relevent comments in paragraphs 224, 234, 238-240, of the judgement, available online at:

I suspect that most have got out that wanted to anyway.
