BHP rail row to be heard in High Court

The legal battle over third party access to BHP's rail lines in mining areas continues with the High Court granting the company leave to appeal against a Federal Court ruling.
The original court action was initiated by Fortescue Metals Group (FMG), which is building its own iron ore project in the Western Australian Pilbara.
The Federal Court ruled that the rail lines are not an integral part of the ore production process.
FMG, which is headed by Australia's richest man Andrew Forrest, believes under the Trade Practices Act, BHP must allow access to its rail lines.
The matter is likely to be heard in the High Court in July or August.
